The Supreme Court of India recently revolutionized adoptive maternity benefits by striking down restrictive legal provisions. Consequently, this landmark decision ensures that mothers who adopt children over three months old receive the same support as biological parents. Furthermore, the bench ruled that biological factors alone do not define a family. Therefore, the right to equality remains paramount in childcare legislation.

Expanding Adoptive Maternity Benefits

Moving forward, the court struck down Section 60(4) of the Social Security Code, 2020. This provision previously limited benefits to mothers adopting infants under three months of age. However, the bench observed that an older child’s needs are no different from those of a newborn. Moreover, they declared the restriction as arbitrary and a violation of Article 14. Consequently, adoptive mothers can now access leave without age-based discrimination.

Push for National Paternity Leave

In addition to maternal rights, the court addressed the role of fathers. They urged the Centre to formalize paternity leave as a vital social security benefit. Justices JB Pardiwala and R Mahadevan emphasized that leave durations must respond to both parent and child needs. Although the government must determine the specifics, this call marks a significant shift in Indian labor policy. Thus, the ruling promotes a more inclusive approach to modern parenting.

Frequently Asked Questions

Q2: Why did the Supreme Court strike down the previous provision?

The court found that restricting benefits based on the child's age was arbitrary and violated the right to equality under Article 14 of the Constitution.

Q3: What is the status of paternity leave in India following this judgement?

While not yet a law, the Supreme Court has strongly urged the Central Government to create provisions recognizing paternity leave as a social security benefit.
